"Publisher" means any person who distributes this program or any part thereof to other persons. "User" means any person who uses this program or any part thereof.

1.) The following rules apply to the liability of the Publisher, regardless of the legal grounds: The Publisher is liable without limitation for its own intent and gross negligence. In the case of gross negligence, however, liability in commercial transactions is limited to compensation for typical foreseeable damage. Otherwise, the Publisher shall not be liable. The limitation period for claims for damages against the Publisher is one year, calculated from the statutory commencement of the limitation period, unless the damage was caused intentionally. The above limitations and restrictions of liability do not apply to claims under the Product Liability Act or to damages arising from injury to life, body or health.

2.) If the Publisher's liability is excluded or limited, the same shall apply to the liability of its employees, vicarious agents and assistants.
